Legislation Belgium

1. Unofficial compilation of the Flemish law, decree and regulations concerning monuments, landscapes and archaeology.

The Flemish Government has accepted the European Treaty of Valetta in principle but it has yet to be ratified by the Flemish parliament.
These regulations only apply for the Flemish territory, including beaches and rivers,
but do not include the North Sea .

2. The Belgian (federal) legislation regarding finds from the Northsea was until now restricted to the wreck decree “wrakkenedict” dating from 10 December 1547 :

  • “Annopende de verdroncken goedynghen ofte die by der Zee opt Stranghe gheworpen ende aldaer ghevischt ofte ghevonden zijn, dat niemandt en vermagh de zelve te husene ofte daer anne handt te slane, zonder den Ontfanghere van den extra-ordinairen de wete te doene."

The new wreck Act of 9 April 2007 on the finding and protection of wrecks has been agreed on but there’s no implementing order yet.
